Kirsten Gibson Art Terms and Conditions

1. General Overview & Eligibility

This Website serves as an online gallery and e-commerce portal offering original fine art, works on paper, and bespoke artistic commissions. By using this Website and placing an order, you represent that you are at least 18 years of age or accessing the Website under the supervision of a parent or legal guardian.

2. Original Artwork & Descriptions

  • One-of-a-Kind Works: All artworks displayed are original, handmade pieces. Natural variations in texture, finish, brushstrokes, and surface characteristics are inherent to the artistic process and constitute part of the piece’s original value.

  • Color Accuracy: We strive to photograph and display colors as accurately as possible under balanced natural lighting. However, actual colors may vary slightly depending on monitor configurations, brightness settings, and device hardware. We cannot guarantee that your display will reflect the physical color tone with absolute precision.

  • Dimensions: Stated dimensions are approximate to the nearest fraction of an inch. Buyers are responsible for measuring their display spaces accurately prior to purchase.

 

3. Orders, Pricing & Payment

  • Order Acceptance: All orders placed through the Website are subject to acceptance and availability. We reserve the right to decline or cancel any order for any reason, including suspected unauthorized transaction activity or stock discrepancies.

  • Pricing & Currency: All prices are listed in U.S. Dollars (USD). 

  • Sales Tax: Applicable state and local sales taxes will be calculated and collected at checkout in accordance with North Carolina law and applicable destination jurisdiction requirements.

  • Payment Processing: Payment must be received in full before an order is packaged, released for local pick-up, or dispatched for shipping.

 

4. Shipping, Local Pick-Up & Risk of Loss

  • Fulfillment Standard: Shipped orders are processed, packaged, and handed over to standard carriers within 3 to 5 business days, unless otherwise noted on commission agreements.

  • Local Pick-Up: Local collection in Charlotte, North Carolina is preferred and available free of charge by appointment.

  • Transfer of Title & Risk: For shipped pieces, title and risk of loss pass to the purchaser once the carrier takes physical possession of the shipment. All shipments are insured for their full declared value. In the event of transit damage, notice and detailed photographic proof must be sent to kirstengibsonart@gmail.com within 48 hours of carrier delivery.

 

5. Return & Cancellation Policy

  • Final Sale: Due to the original, one-of-a-kind nature of fine art, all sales are final. We do not accept returns, issue refunds, or process exchanges for change of mind or personal decorating preference.

  • Commissions: Custom artwork deposits, milestone installments, and completed commission payments are strictly non-refundable once materials are acquired and studio work commences.

 

6. Intellectual Property & Copyright

  • Artist Ownership: Kirsten Gibson retains all copyright and reproduction rights to all original artworks, custom commissions, images, text, logos, and digital assets appearing on this Website or produced by the studio.

  • Collector Rights: The purchase of an original artwork conveys physical ownership of the tangible art piece only. It does not grant copyright, reproduction rights, licensing privileges, or commercial distribution rights.

  • Prohibited Use: No artwork, imagery, photography, or written content from this Website may be reproduced, copied, resold, commercially exhibited, or distributed in any form without prior express written permission from Kirsten Gibson.

 

7. User Conduct & Website Use

You agree not to use the Website for any unlawful purpose, interfere with the security or operation of the site, scrape or harvest data, or introduce harmful code, viruses, or automated scripts.

 

8. Limitation of Liability

To the fullest extent permitted by law, Kirsten Gibson Art, its owners, and affiliates shall not be liable for any direct, indirect, incidental, punitive, or consequential damages resulting from your access to, use of, or inability to use this Website, or from any artwork purchased through the platform.

 

9. Governing Law & Dispute Resolution

These Terms and Conditions shall be governed by, construed, and enforced in accordance with the laws of the State of North Carolina, without regard to conflict of law principles. Any legal action or dispute arising out of these Terms or your use of this Website shall be filed exclusively in the state or federal courts located in Mecklenburg County, North Carolina.
